7. Customer-Submitted Materials, Inspiration Images, and Custom Orders

7.1. Customer-Submitted Materials: Customers may provide Sixpence Handmade with names, photographs, screenshots, artwork, logos, text, graphics, designs, inspiration or reference images, links, or other materials in connection with an inquiry, custom order, personalization request, or other transaction.

We may collect, use, reproduce, store, or include those materials as reasonably necessary to communicate with the customer, prepare order specifications, create mockups or proofs, document customer instructions or approvals, produce and fulfill the order, provide customer service, maintain appropriate business records, resolve disputes, or protect our legitimate business interests.

7.2. Order Forms and Specification Sheets: Customer-submitted materials may be included on internal order forms, specification sheets, mockups, proofs, production documentation, or other records used to communicate, document, prepare, produce, or verify an order.

7.3. Third-Party Materials: The inclusion of a third-party photograph, screenshot, design, artwork, logo, reference image, or other material in Sixpence Handmade's order documentation does not constitute a claim by Sixpence Handmade of ownership, authorship, creation, or other rights in that material or in third-party work depicted in the material.

Third-party materials remain subject to the rights of their respective owners.

7.4. Customer Responsibility for Submitted Materials: Customers are responsible for ensuring that they have all rights, licenses, permissions, consents, and authorizations necessary to provide and request the use, reproduction, modification, embroidery, printing, or other customization of any photographs, artwork, logos, trademarks, service marks, trade names, business or organization logos, school or team logos, sports-related marks, characters, graphics, designs, names, images, likenesses, or other materials submitted to Sixpence Handmade.

If a customer does not personally own or otherwise have authority to authorize the requested use of protected material, Sixpence Handmade may require written authorization from the applicable rights holder before accepting or finalizing the order. The authorization should specifically identify the material and authorize Sixpence Handmade to reproduce or otherwise use it for the requested purpose. Sixpence Handmade may also require the name, title, organization, telephone number, email address, or other appropriate contact information for the person granting authorization so that the authorization may be independently verified.

Sixpence Handmade reserves the right to contact the purported rights holder or authorizing organization directly to verify any authorization provided. An order involving such material may be declined, canceled, or placed on hold if authorization cannot be verified to our satisfaction or if we otherwise believe the requested use may infringe or violate intellectual-property, privacy, publicity, or other rights or applicable law.

Submission of material or written authorization does not require Sixpence Handmade to accept or complete a requested order.

Submission of any material to Sixpence Handmade does not constitute a representation by Sixpence Handmade that the material may lawfully be reproduced or used. Sixpence Handmade does not claim ownership of customer-submitted or third-party materials merely because they are received, displayed on an order form or specification sheet, or used as reference material.

Additional terms governing customer-submitted materials, intellectual property, customer representations, authorization verification, and responsibility for authorized use are provided in our Terms of Service.

8. Communications and Marketing

8.1. Transactional Communications: If you provide an email address, telephone number, or other contact information, we may use it to communicate with you regarding your order, custom request, account, approval, payment, shipping, customer-service request, or other transaction.

These communications may be necessary to provide the Services you requested.

You may unsubscribe from promotional emails by following the unsubscribe instructions included in those communications or using other available preference controls.

8.3. Transactional Messages After Opt-Out: Opting out of marketing communications will not prevent us from sending non-promotional communications reasonably necessary to administer an order, account, transaction, customer-service matter, legal notice, or similar business relationship.

9. Children's Privacy

Our website and Services are intended for adults and are not directed toward children.

We do not knowingly collect personal information directly from children in a manner prohibited by applicable law.

Adults may purchase products for children and may provide information relating to a child when reasonably necessary to personalize or fulfill an order. Such information may include a child's name, initials, birth date, age, school, team, or other personalization information voluntarily provided by the purchasing customer.

Customers should provide only the information reasonably necessary for the requested product or personalization.

If you believe personal information concerning a child has been provided to us improperly, please contact us so that we can review the circumstances and take appropriate action where required.

10. Data Security

We use reasonable administrative, technical, and physical measures appropriate to our business and the nature of the information we handle to help protect personal information against unauthorized access, use, alteration, disclosure, loss, or destruction.

However, no website, electronic transmission, storage system, or security measure can be guaranteed to be completely secure. Accordingly, we cannot guarantee the absolute security of information transmitted to, processed by, or stored through our website, Shopify, service providers, electronic communications, or other systems.

Customers should use appropriate caution when transmitting sensitive information electronically.

11. Data Retention

We retain information for as long as reasonably necessary for the purposes for which it was collected and for legitimate business purposes, which may include:

  • Processing and fulfilling orders;
  • Maintaining order and transaction histories;
  • Maintaining custom-order specifications, proofs, approvals, and related communications;

  • Complying with legal, regulatory, accounting, tax, or other obligations.

Retention periods may vary depending on the type of information, the purpose for which it is maintained, applicable legal requirements, and legitimate business needs.

When information is no longer reasonably necessary, we may delete, destroy, anonymize, or otherwise dispose of it as appropriate.

12. Your Privacy Rights and Choices

Depending on where you live and applicable law, you may have certain rights concerning your personal information. These may include the right to:

  • Request access to certain personal information;
  • Request correction of inaccurate personal information;
  • Request deletion of certain personal information;
  • Request a portable copy of certain personal information;
  • Opt out of certain types of sale, sharing, targeted advertising, or other processing where applicable;
  • Withdraw consent where processing is based on consent and applicable law permits withdrawal; and
  • Exercise other privacy rights provided by applicable law.

Privacy rights are not absolute and may be subject to exceptions, limitations, eligibility requirements, identity verification, record-retention obligations, legal claims, or other requirements permitted by law.

For example, a request to delete information does not necessarily require Sixpence Handmade to delete records that we are permitted or required to retain for legitimate business, transaction, tax, accounting, fraud-prevention, dispute-resolution, legal, or compliance purposes.

We may request information reasonably necessary to verify your identity or authority before processing certain requests.

To exercise an applicable privacy right, please contact us using the information provided below or use privacy controls made available through our website, where applicable.

13. Third-Party Websites and Services

Our website may contain links to or integrate with websites, social-media platforms, payment providers, shipping services, applications, or other third-party services that are not operated or controlled by Sixpence Handmade.

Sixpence Handmade is not responsible for the privacy, security, content, availability, or practices of third-party websites or services.

Your interaction with a third-party website or service is subject to that third party's own terms, privacy policies, and practices. We encourage customers to review those policies before providing information to a third party.

14. International Data Transfers

Because Shopify and certain service providers may operate internationally, personal information may be transferred to, stored in, accessed from, or processed in countries outside the country in which you reside.

The privacy and data-protection laws of those countries may differ from those in your jurisdiction.

Where applicable law requires particular safeguards or protections for an international transfer, the applicable service provider or party responsible for the transfer will use measures required by applicable law.

15. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our business practices, Services, technology, third-party services, or applicable legal requirements.

When we update this Privacy Policy, we will post the revised version and update the Effective Date.

Changes will apply as permitted by applicable law. Where applicable law requires additional notice or consent regarding a material change in how personal information is handled, we will provide such notice or obtain such consent as required.
