This Legal Notice applies to the Sixpence Handmade website, products, services, photographs, content, and other materials made available by or through Sixpence Handmade. Please review this notice together with our Terms of Service and other applicable policies.

1. Sixpence Handmade Content and Intellectual Property

1.1. Sixpence Handmade Materials: Except for customer-submitted or third-party materials and except where otherwise stated, photographs, original artwork, graphics, designs, illustrations, mockups, product images, website content, written content, branding, logos, layouts, templates, and other original materials owned or lawfully controlled by Sixpence Handmade ("Sixpence Handmade Materials") are protected to the extent provided by applicable intellectual-property law.

1.2. No Permission Through Public Display: The appearance or availability of Sixpence Handmade Materials on our website, social media, product listings, mockups, Design Specifications, or other materials does not grant permission to copy, reproduce, distribute, sell, commercially exploit, or otherwise use those materials except as permitted by applicable law or with prior written permission from Sixpence Handmade.

1.3. Photographs and Product Images: Sixpence Handmade does not authorize photographs or product images owned by Sixpence Handmade to be submitted, sent, forwarded, shown, or otherwise provided to another decorator, embroiderer, printer, designer, manufacturer, seller, or other business for the purpose of reproducing, imitating, recreating, or commercially producing the product, design, arrangement, or other original work depicted in the photograph.

Nothing in this section restricts a use that Sixpence Handmade cannot lawfully prohibit.

2. Third-Party Trademarks, Logos, Designs, and Other Materials

2.1. Third-Party Ownership: Trademarks, service marks, trade names, logos, school or team marks, business or organization logos, characters, artwork, photographs, designs, and other intellectual property belonging to third parties remain the property of their respective owners.

Sixpence Handmade does not claim ownership of third-party intellectual property merely because it appears in a product example, customer order, photograph, mockup, Design Specification, inspiration image, or other material.

2.2. No Affiliation or Endorsement: The appearance of a school, team, business, organization, brand, logo, trademark, character, or other third-party material on the Sixpence Handmade website, social media, product examples, or other materials does not, by itself, imply that Sixpence Handmade is affiliated with, sponsored by, endorsed by, licensed by, or otherwise officially connected with the applicable rights holder.

Any authorized relationship will be identified when appropriate.

2.3. Customer Authorization: Customers requesting reproduction or use of protected third-party materials are responsible for possessing all rights, licenses, permissions, consents, and authorizations necessary for the requested use.

Sixpence Handmade may require written authorization from the applicable rights holder and may independently verify that authorization before accepting or completing an order.

Sixpence Handmade reserves the right to decline any request involving third-party intellectual property.

Additional requirements concerning Customer-Submitted Materials and authorization are provided in our Terms of Service.

3. Inspiration and Reference Images

3.1. Customer-Provided Inspiration: Customers may provide photographs, screenshots, examples of another creator's work, or other images as inspiration or reference material when discussing a custom order.

Receipt or use of such material for reference, communication, or order documentation does not mean that Sixpence Handmade created, owns, or claims ownership of the original photograph, product, design, or other work depicted.

3.2. Design Specifications and Order Documentation: Customer-provided inspiration or reference images may appear on a Design Specification, mockup, proof, or other order documentation for the purpose of identifying or communicating the customer's requested style, concept, or specifications.

The inclusion of a third-party image in such documentation does not constitute a claim by Sixpence Handmade that the image or work depicted is ours.

3.3. No Transfer of Rights: Providing inspiration or reference material does not transfer intellectual-property rights to Sixpence Handmade and does not establish that the customer possesses the legal right to authorize reproduction of protected elements contained within the material.

4. Production and Working Files

4.1. Digitizing and File Preparation: Sixpence Handmade may create or prepare embroidery files, digitized files, vector files, print-ready files, cut files, production files, working files, source files, templates, or other production materials in connection with an order.

Fees charged for digitizing, vectorizing, artwork preparation, setup, conversion, or similar services compensate Sixpence Handmade for the preparation service and do not constitute the purchase or transfer of the resulting production or working file.

4.2. Files Are Not Released: Unless Sixpence Handmade expressly agrees otherwise in a separate written agreement, production and working files created or prepared by Sixpence Handmade for use in our production process are retained by Sixpence Handmade and are not sold, transferred, released, emailed, downloaded, copied, or otherwise provided to customers, other decorators, or third parties.

Payment of a digitizing, vectorizing, artwork-preparation, setup, or similar fee does not entitle the customer to receive the production or working file.

4.3. Underlying Intellectual Property: Sixpence Handmade's retention of a production or working file does not constitute ownership of customer-owned or third-party intellectual property incorporated into that file.

5. Website and Product Information

5.1. Accuracy: Sixpence Handmade makes reasonable efforts to provide accurate website, product, pricing, availability, and other information. However, typographical errors, inaccuracies, omissions, technical errors, or outdated information may occasionally occur.

5.2. Corrections: To the fullest extent permitted by applicable law, Sixpence Handmade reserves the right to correct errors or inaccuracies and update information when discovered.

If an error materially affects an order that has already been placed, the matter will be handled in accordance with our Terms of Service, applicable policies, and applicable law.

5.3. Product Representation: Product photographs, digital images, mockups, and other visual representations may vary from the finished physical product due to differences in displays, materials, handmade production, sizing, placement, and other factors described more fully in our Terms of Service.

6. Relationship to Terms and Policies

This Legal Notice is intended to supplement Sixpence Handmade's Terms of Service and other applicable policies.

The Terms of Service contain additional provisions concerning customer-submitted materials, intellectual-property authorization, production files, mockups and Design Specifications, customer representations and warranties, indemnification, limitations of liability, disputes, and other legal terms governing use of our Services and purchases from Sixpence Handmade.

Nothing in this Legal Notice is intended to create rights or obligations inconsistent with applicable law or to exclude or limit any right or liability that cannot legally be excluded or limited.

7. Governing Law

To the extent permitted by applicable law, this Legal Notice will be governed by the laws of the State of North Carolina, without regard to conflict-of-law principles, except where applicable federal law or other law requires otherwise.
